Chamber of deputies outvotes Senate and supports tax breaks for zoos

Zoological gardens will in the future have certain tax benefits. In particular they will be freed of paying income taxes on donations and advertising. The Chamber of Deputies again approved this version of the law. The deputies outvoted the Senate, which had suggested excluding this benefit out of concerns over tax evasion, and had returned the draft bill to the Chamber of Deputies.

The senators also objected to the fact that the tax break would only apply to zoos and not to other beneficial institutions such as museums. However, the deputies reached the conclusion that zoos need this kind of help and the tax evasion risk is not very high. The law states that a Ministry of the Environment licence will be required for running a zoo. The Ministry will assess how the applicant will look after the animals, how they will be housed, what kind of veterinary care will be provided to the animals, and whether there is enough specialised staff.

The new amendment does not mean that the existing zoos in the Czech Republic will have to obtain a license immediately after the law comes into force. It is enough if zoos apply for a license within six months after the law comes into force. Until their requests are processed they will be considered license holders. The law will differentiate between zoological gardens and rescue breeding centres of endangered and rare species on one hand, and commercial menageries and shelters on the other, and harmonize Czech legislation with EU law. The operation of zoos is not subject to internal regulations stipulated by the founder, usually the municipality. Minister of the Environment Libor Ambrozek (KDU-ČSL) claims that small menageries will be able to exist, but they can be run commercially only with licences. Those who want to collect admission and call their facility a zoo will have to meet certain conditions, Ambrozek said.
