A temporary residence permit for a family member of an EU citizen

An application for temporary residence permit for a family member of an EU citizen, who is not an EU citizen (who is a family member of an EU citizen - see "Who is an EU citizen and his family member") is filled in an appropriate form.

The application will be supported by:

The requirements for the application shall not be older than 180 days with the exception of the travel document, public documents (i. e. a birth certificate, marriage notarial act etc.) and the photograph of the applicant if it corresponds to his/her actual appearance. All the documents have to be submitted in originals or notarized copies. Travel document and public documents must be always submitted in the original. All of the presented documents have to be made out in the Czech language or Slovak language or officially translated into Czech.

An application can be filled in personally at any MOI office in the Czech Republic, that being within 3 months of entering the country. . If foreigner becomes a family member of an EU citizen during the stay in the territory, he/ she is obliged to apply for a temporary residence permit in the period up to 3 months from the day, when he/ she became a family member of an EU citizen. If foreigner becomes a family member of an EU citizen during the stay in the territory and he/ she has different residence permit, he/ she is obliged to apply for a temporary residence permit in the period up to 3 months from the day of expiry of this residence permit. With regard to the possible personal contact with the MOI office where the application was administered, it is recommended to administer the application at the nearest MOI office to your registered residence.

The application is processed within 60 days of initiating the process.

MOI office attests permission to stay in the Czech Republic until the final legal decision for the application for temporary residence permit for a family member of an EU citizen by visa sticker placed in the passport, in form of visa for residence over 90 days with the validity period, which appertains presumed length of procedures of an application; it shall not apply, if it is a foreigner who is filed in informational system of contracting states. Only confirmation of permission to stay is issued to this foreigner. Validity of the document or confirmation, which attests permission to stay in the Czech Republic, terminates by the final legal for the application.

In the case of a positive decision, the applicant is invited in writing or by telephone by the MOI office to pick up the temporary residence permit.

The residence card for a family member of an EU citizen is issued for a period identical to the expected stay period of the EU citizen, 5 years at the longest.

At the same time, the MOI issues a personal identity number.
