A temporary residence permit for a family member of an EU citizen

An application for temporary residence permit for a family member of an EU citizen, who is not an EU citizen (who is a family member of an EU citizen - see "Who is an EU citizen and his family member") is filled in a form Application for a temporary residence permit for a family member of an EU citizen.
 

An application will be supported by the following documents:

  • a travel document,

  • a document confirming that he/she is a family member of an EU citizen,

  • photographs,

  • medical insurance document, in the case of so-called extended family members, document on travel medical insurance in scope of comprehensive healthcare for the entire duration of the assumed residence on the territory of the CZ,

  • a document on ensuring of accommodation on the territory of the CZ,

  • a document on residence of EU citizen on the territory (not required if a registration certificate or permanent residence permit has been issued to an EU citizen or if the applicant is a family member of a citizen of the Czech Republic who is registered as permanently resident on the territory of the Czech Republic),

  • a document on family aggregate monthly income after unification (a proof of funds) - this document is required just in the case of so-called extended family members of EU citizens and it has to prove the availability of funds as in the case of the application for an issuing a long-term residence permit for the purpose of family reunification; jointly assessed persons will be determined analogically. The requirements for the application shall not be older than 180 days with the exception of the travel document, public documents (i. e. a birth certificate, marriage notarial act etc.) and the photograph of the applicant if it corresponds to his/her actual appearance. All the documents have to be submitted in originals or notarized copies. Travel document and public documents must be always submitted in the original. All of the presented documents have to be made out in the Czech language or Slovak language or officially translated into Czech.

An application can be filled in personally at any MOI office in the Czech Republic, that being within 3 months of entering the country. If a foreigner becomes a so-called immediate family memberof an EU citizen during the stay in the territory, he/she is obliged to apply for a temporary residence permit in the period up to 3 months from the day, when he/she became a so-called immediate family member of an EU citizen. If foreigner becomes a family member of an EU citizen during the stay in the territory and he/ she has different residence permit, he/ she is obliged to apply for a temporary residence permit in the period up to 3 months from the day of expiry of this residence permit. In the case of a so-called extended family member it is not possible to submit an application at a time when the applicant is not authorised to reside on the territory or at a time when he/she is on the territory on the basis of an exit order, or if he/she is the holder of a short-term visa (with the exception of a short-term visa granted to a family member of an EU citizen). With regard to the possible personal contact with the MOI office where the application was administered, it is recommended to administer the application at the nearest MOI office to your registered residence.

The application is processed within 60 days of initiating the process.

The MOI CZ will certify authorisation to be on the territory until a decision comes into legal force, or in the case of extended family members, up to the moment of announcement of a decision on an application for issue of permission for temporary residence of the family member of an EU citizen, by means of a visa sticker in the travel document, and it shall do so in the form of a visa for residence in excess of 90 days with validity period corresponding to the assumed length of the application proceedings; this shall not apply in the case of a foreign national included in the information system of treaty states, to whom only a confirmation of residence authorisation will be issued. The validity of the document or confirmation certifying authorisation to reside on the territory expires when the decision on the application comes into force, and in the case of so-called extended family members at the moment of announcement (delivery) of the decision on the application.

If the application is granted, the applicant is called upon by the Department of asylum and migration policy of the MOI CZ by telephone or in writing to prepare the information necessary for the issuance of a residence card or residence permit, including the acquisition of biometric data.

At the same time, the MOI issues a personal identity number.
