So far, Luxembourg has neither appointed a national rapporteur, nor it created other mechanisms for this area. The informal coordination works on an ad hoc basis.
 
The legislative proposal (Bill No.5874), which has not been adopted yet, concerns victims of trafficking in human beings and their protection. Article 12 of the bill proposed to establish a Committee to monitor trafficking in human beings to coordinate and monitor prevention and to evaluate the threat posed by such trafficking.
 
The Committee to monitor trafficking in human beings will be the only coordination body in this field. It will be composed of representatives of public bodies responsible for the implementation of the proposal, representatives of assistance services, and approved organizations. The composition, organizational structure, and tasks of this Committee will be stipulated by a Grand Duchy regulation, which has not yet entered into force.
 
Currently, the Luxembourg authorities work on an analysis to determine the potential need for a national rapporteur to complement the work of the Committee to monitor trafficking in human beings.

9. What are the main tasks and responsibilities of the National Rapporteur in your country?
Not relevant.
  • 9.1.Monitoring and analyses of the situation, trends and possible threads.
    The Committee to monitor trafficking in human beings will be, under the scope of the above legislation, responsible for establishing mechanisms to coordinate and monitor prevention and to evaluate the threat posed by trafficking. 
     
    The Committee to monitor trafficking in human beings will collect and analyse statistical data which will be submitted to it. Furthermore, it will supervise implementation of the relevant legislation to combat trafficking in human beings and evaluate such process. It will oversee the enforcement of its provisions, which are aimed at strengthening of the rights of victims and improving the witness protection. At the same time, it will focus of the enforcement of the legal provisions guiding the free movement of people and migration and will analyse problems related to the implementation of law, which will be referred to it by its members. 
  • 9.4.Collection of data on trafficking in human beings.
    • 9.2.2. There is a central collection of a statistical data on trafficking in human beings and the data is received from various stakeholders.
      • 9.2.2.4.       If yes, please provide information on the nature of the stakeholders. (E. g. Ministry of Justice, Police, Labour Inspectors, Embassies, NGOs, etc.).
        Under the above proposal, the police, offices of prosecution, penal courts, assistance services, and other public bodies participating in prevention and combating of trafficking in human beings will draft annual statistics to compare the cases as regards the age, sex, country of origin, modus operandi of the traffickers, and other details. These statistics will reveal many important figures, such as number of charges, criminal prosecutions, judgements, victim protection measures, etc.
    • 9.2.2.  Is some of the data collected directly by the National Rapporteurs office? (E. g. personal data on the following).

  • 9.4.Coordination of anti-trafficking activities on a national level.
    The legislative proposal assumes that the police and the assistance services will cooperate to efficiently and properly protect the victims against any potential revenge or threats from the side of the traffickers, especially during the time the victim is given to reflect upon what had happened, as well as in the course of the investigation, prosecution, and court proceedings against the perpetrators. 
    To this end, the above authorities shall, if necessary, exchange information to expedite the process and to evaluate risks to the victim.
