EU treaties are generally thought of as dry and sophisticated reading for distracted academics. So it may come as a surprise that the draft Constitution for Europe has received so much publicity lately. It does indeed deserve the attention of Czech citizens, but not for the reasons sometimes claimed. The Constitution will not transform the EU into a super-State. Rather, it will make the EU more workable, more transparent and more democratic. That is why it deserves our attention.

The draft foresees giving more power to the European Parliament, national parliaments and individual citizens. The European Parliament, including 24 elected representatives of the Czech Republic, will have the final say on the European Commission’s President and will have an equal say, alongside the Council of Ministers, on most legislative issues. National parliaments will be able to scrutinize EU laws and return them to the Commission for reconsideration. Individual citizens will also be able to directly influence EU legislation by collecting million signatures in support of a legislative proposal.

The current and future EU Member States are well aware that the institutional and decision-making system needs an urgent reform to accommodate the realities of an organization made of 25 countries. Therefore, the draft Constitution increases the number of areas where the EU can take decisions by qualified majority voting, since unanimity at 25 risks paralysis. It also enables the EU to coordinate foreign policy issues with the help of a new Foreign Minister, answerable to both the Council of Ministers and the Commission. At the same time, national vetoes will remain in areas like fiscal and foreign policies.
