Voluntary Returns organised by the Department of Asylum and Migration Policy

 

Basic conditions for departure from the territory under the voluntary return programme

Who can participate in the voluntary return programme?

Foreign nationals who have been issued an administrative expulsion decision or a decision on obligation to leave the territory of the Czech Republic and the territory of the Member States of the EU, on condition that they have been given a deadline for departure, and also foreign nationals detained for the purpose of administrative expulsion may apply for voluntary return.

Foreign nationals residing in the Czech Republic long-term or permanently for employment or study purposes whose residence has been cancelled or not extended by the Czech authorities and EU citizens whose temporary residence has expired and family members of EU citizens whose temporary residence has terminated may also apply for voluntary return. A condition is that such a foreign national is staying in the territory of the Czech Republic on the basis of a removal order, is serving a prison sentence or has received a penalty of removal.

The foreign national must hold a valid travel document for return to be possible. If he/she does not hold a valid travel document, the Ministry of the Interior may assist him/her in obtaining a new document (laissez-passer).
 

Assistance for voluntary return

The Ministry of the Interior organises the foreign national’s journey to his/her country of origin. If necessary, the Ministry will also assist in obtaining transit authorisation. Ministry of the Interior staff will help foreign nationals at the airport in Prague with check-in and passport control.
 

Advantages of voluntary return

  1. Speed - if the foreign national holds a valid travel document, return may be implemented immediately after termination of all residence-related matters or after issuance of an administrative removal decision; the Ministry will attempt to arrange the fastest possible connection for the return journey to the country of origin.

  2. Financial assistance - the Ministry of the Interior will buy the ticket for the foreign national’s  return journey in his/her country of origin, which means that the foreign national may leave the Czech Republic even if he/she does not have the necessary funds at his/her disposal to buy a ticket him/herself. And, to enable the foreign national to take a suitcase with him/her, the ticket will of course cover a potential luggage fee. In exceptional cases, financial assistance may also cover other expenses connected with their return.

  3. Dignified return - on the return journey to his/her country of origin the foreign national is not accompanied by the Police of the Czech Republic or by any other employee of the public authorities of the Czech Republic, but returns like an ordinary tourist.

  4. Opportunity to shorten the ban period imposed on a foreign national - the foreign national may apply for this after returning to his/her country of origin. This application may be made under the condition that the foreign national repays half of the costs of the journey to the country of origin; thereafter you will have no debt towards the Czech Republic.

  5. Post-return reintegration assistance - this concerns isolated cases of foreign nationals returning to a third country for which the EU has not introduced visa liberalisation. This assistance is organised by the International Organisation for Migration.

After submitting an application for assistance, foreign nationals will be required to cooperate with the Ministry of the Interior staff organising their departure. They must inform staff of any change that occurs that may affect their plans to depart (health, family, job-related circumstances etc.).
