Information of Ministry of the Interior to applications of residence permits submitted by foreign nationals in the Czech Republic during the state of emergency

Due to emergency measure of the Government of the Czech Republic (Government Resolution no. 348/2020) and extraordinary measure of Ministry of Health for the purpose to reduce the movement of persons and activity of institutions for health reasons, there will be this procedure of the Ministry of the Interior with applications of residence permits submitted in the Czech Republic during the state of emergency:

An application of residence permit, which must be submitted personally by foreign national and its submission is connected with period or should be submitted at some time, foreign national can send by post to MOI offices or it can be delivered to data box of the Ministry of the Interior (ID: 6bnaawp).

1. Possibility of delivery of an application by post or to data box, if the law defines the obligation of its personal submission

  1. Long-term residence permit applications
    Long-term residence permit application (including Employee Card and Blue Card) send by post or to data box will be accepted and assessed by the Ministry of the Interior as it would be submitted personally. It will not be necessary to visit MOI office personally within 5 days. Due to necessity of payment of administrative fee for acceptance of application in revenue stamp form, we recommend you to send your application by post.

  2. Long-term or Permanent residence permit applications of the child born in the Czech Republic (§ 88 of the Act on the Residence of Foreign Nationals in the Czech Republic)
    Long-term or Permanent residence permit applications of the child born in territory of the Czech Republic, which is sent by post or to data box of the Ministry of the Interior, will be accepted and assessed by the Ministry of the Interior as it would be submitted personally. Due to necessity of payment of administrative fee for acceptance of application in revenue stamp form, we recommend you to send your application by post. Application confirmation for the purpose of health insurance will be sent to legal representatives of applicant. Write an address to the form, on which you are able to accept the letter!
    In exceptional cases, based on the assessment of the head of the relevant office of the Ministry of the Interior, it is possible to allow a personal application.

  3. Permanent residence permit applications
    It possible to send Permanent residence permit application by post or to data box. Because there is no period for foreign nationals for submission of these applications by the law, defect of failure condition of personal submission will be solved after end of the status of emergency (foreign national will be asked to remove the defect). It does not apply for Permanent resident permit applications of the child born in the Czech Republic due to § 88 of the Act on the Residence of Foreign Nationals in the Czech Republic (please see previous point).

  4. A temporary residence permit applications for a family member of an EU citizen
    The Ministry of the Interior will accept a temporary residence permit application for a family member of an EU citizen send by post or to data box as it would be submitted personally. It will not be necessary to visit MOI office personally within 5 days. Defect of failure condition of personal submission will be solved after end of the status of emergency (foreign national will be asked to remove the defect). If foreign national does not reside in the Czech Republic, he/she is not authorized to submit an application for temporary residence permit for a family member of an EU citizen. Application procedure will be stopped in that case.

  5. A certificate of temporary residence for an EU citizen
    An application for a certificate of temporary residence for an EU citizen can be sent by post or to data box of Ministry of Interior of the Czech Republic. It is necessary to submit an application with all application requirements, when submitting travel document - simple copy of the travel document with page of personal data is fine. EU citizen is not authorized to submit an application, if he/she is not in the Czech Republic at the time of submitting of an application. Application procedure will be stopped in that case.
     

IMPORTANT: Sign yourself all applications for resident permits sent to MOI offices! Send your applications to the Ministry of the Interior by post or via data box; do not send them via email without guaranteed electronic signature. Applications sent by simple email will not be considered!

  

2. Submission of requirements for the application

Requirements required by law must be enclosed to the submitted application in the form of originals or certified copies of documents and documents. This does not apply for travel document and registry documents, whose submission will be accepted by the Ministry of the Interior in plain copies (at passport plain copy from all sides).

Before the acquisition of biometric data for the purpose of issuance of residence permit card (or before personal collecting of residence permit, if biometric residence permit card is not issued to foreign national) travel document or registry documents will be checked in MOI office.

This also applies to applications for which personal participation is not required by law (an application for an extension the validity of a long-term residence permit or a certificate of temporary residence for an EU citizen) and applications will be submitted by post or to data box. Applications sent by simple email (without guaranteed electronic signature) will not be considered!

  

3. Acts of proceeding required personal participation of foreign national

There will be no interrogations, no acquaint with the documents for issuing decision by access to the files and not allowed access to the files by the Ministry of the Interior during the whole state of emergency. All previous terms of interrogations, acquaint with the documents and access to the files are cancelled, participants of proceedings will be informed separately.

  

4. The application form for change of employer, work position or employment on another work position by same or another employer

From March 19th, 2020, the condition for notice of change of employer at the earliest after 6 months from coming into force of the decision of employee card submission is cancelled. Foreign national is still obliged to report the change to the Ministry of the Interior under conditions defined by the law.

If new employer of foreign national implements crises measures or facilitates their implementation, it is enough, if foreign national reports the change no later than the day when he/she enters into new working position. The obligation to register new job as available for foreign nationals in the Evidence of vacancies led by the Ministry of Labour and Social Affairs is not affected by this measure!

Foreign national proves that his/her employer implements crises measures by employer´s statement, which will be submitted with the notice of change. There will be no notice of fulfilment of conditions of change of employer, work position, employment on another work position by the same or another employer from the Ministry of the Interior to the foreign national or employer. Conditions are considered as fulfilled by this notification.

NOTICE!
In accordance with the Article IV point 3 of the Resolution No. 443 adopted by the Government of the Czech Republic on April 23rd, 2020 (193/2020 Coll.), the 60 days period after which the validity of Employee Card is ceases has been stopped. This time period will start again in full length (i.e. new 60 days) after the end of the State of Emergency.

What does it mean? If the Employee Card holder lost his/her job during the State of Emergency (since March 12th, 2020), he/she will be entitled to find a new job and to notify a new employer in 60 days after the end of the State of Emergency. Same applies to the Employee card holder who lost his/her job in the period not exceeding 60 days before the declaration of State of Emergency (i. e. 60 days before March 12th, 2020).

The ban of changing employer to agency is not affected by this!

Information above applies similarly to Blue Card holders.

  

All these measures are only valid for the duration of the state of emergency.
