Úloha orgánů státní správy při přípravě a sjednávání předpisů Evropské unie a jejich následném provádění

Shrnutí:
Článek se zaměřuje na roli orgánů státní správy při přípravě a sjednávání právních předpisů EU a jejich následné implementaci a dále na pravidla a procedury, kterými se orgány státní správy při zajištění výše zmíněných činností řídí.
V obou uvedených činnostech hraje klíčovou roli vláda, resp. ministerstva a ostatní ústřední správní úřady a jejich úředníci. V rámci státní správy existují nicméně i podpůrné specializované útvary.
Příprava pozic České republiky pro jednání v orgánech EU, upravená zejména ve Statutu Výboru pro EU, se odehrává na třech úrovních: resortní, meziresortní a vládní přičemž každá z těchto úrovní je reprezentována příslušným orgánem, a to tzv. resortními koordinačními skupinami, Výborem pro EU na pracovní úrovni a Výborem pro EU na úrovni vládní.
Neméně důležitá je následná implementace platných právních předpisů EU prostřednictvím vnitrostátních právních předpisů, upravená Metodickými pokyny pro zajišťování prací při plnění legislativních závazků vyplývajících z členství České republiky v EU. Kromě jednotlivých ministerstev v této oblasti hraje klíčovou koordinační a podpůrnou roli též odbor kompatibility působící pod Úřadem vlády.
The role of state administration during the preparation and negotiation of the legislative acts of the EU
Summary:
The article focuses on the role of state administration during the preparation and negotiation of the legislative acts of the EU and their subsequent implementation in particular on the rules and procedures governing the above-mentioned activities.
In both of these activities, the government, respectively the ministries and other central administrative bodies and their experts, play the most important role. Nevertheless, in the framework of the state administration specialized and supporting bodies exist.
Preparation of the Czech position for the negotiation in the EU institutions, provided for in the Statute of the Committee for the EU, takes place on three levels: ministerial, interministerial and governmental. Each of these levels is represented by the competent body – ministerial coordination groups, the Committee for the EU at working level and finally the Committee for the EU at governmental level.
Important is also subsequent implementation of EU legislative acts in force by the means of the national law provided for in the Methodical Instructions for the Organisation of Work when Meeting the Legislative Obligations Ensuing from the Membership of the Czech Republic in the European Union. Along with the ministries, the Department for Compatibility, as a part of the Office of the Government plays, important coordinating and supporting role in the process of implementation of the legislative acts of the EU.
