Pohled na polistopadovou historii Legislativní rady vlády České republiky do roku 2005

Článek se zabývá postavením a funkcí Legislativní rady vlády České republiky v letech 1990 až 2005. Rozděluje toto období do dvou základních časových úseků. Klíčem k tomuto rozdělení je úprava postavení a funkce Legislativní rady v příslušných legislativních dokumentech. V roce 1998 byla provedena zásadní změna v legislativních dokumentech upravujících postavení a funkci Legislativní rady i jejích orgánů. Tato změna byla doprovázena radikálním personálním opatřením. Poprvé od roku 1990 byla odvolána celá Legislativní rada a jmenována Legislativní rada nová. Vše nasvědčuje tomu, že tímto krokem byla započata nová etapa v polistopadové historii Legislativní rady.

Vedle rozboru příslušných legislativních dokumentů, upravujících postavení a působnost Legislativní rady, je značná pozornost věnována faktickému fungování Legislativní rady a jejích orgánů. Faktické fungování Legislativní rady v různých obdobích je dokumentováno na konkrétních příkladech. Ukazuje se, že formální zakotvení Legislativní rady vždy nebylo rozhodujícím faktorem pro ovlivňování legislativního procesu a vždy primárně neregulovalo její činnost. Rozhodujícím faktorem však vždy byl vztah vlády a jejích ministrů k Legislativní radě. Významně byl tento vztah ovlivňován postojem předsedy vlády. Činnost Legislativní rady vždy též byla ovlivňována jejími předsedy. Období, kdy v čele Legislativní rady nestál člen vlády, stejně jako období poznamenaná častými výměnami předsedů Legislativní rady, byla pro činnost Legislativní rady nejkritičtější. Navzdory různým obdobím, jimiž Legislativní rada vlády České republiky procházela, navzdory různým vlivům, kterým byla vystavena, sehrála ve vývoji české legislativy pozitivní roli.

 

A view on the after-November history of the Legislation Council of the Czech Republic until 2005

Summary:

The article deals with the role and functions of the Legislation Council of the Czech Republic between 1990 and 2005. It divides this period into two principal time sections. The key to this division is the regulation of the role and functions of the Legislation Council in relevant legislative documents. In 1998, a crucial amendment was made to legislative documents regulating the role and functions of Legislation Council and its bodies. This amendment was followed by radical personnel measures. For the first time from 1990 the whole Legislation Council was recalled and a new Legislation Council was appointed. This all indicates that by this step a new period in the after-November history of the Legislation Council was initiated.

In addition to the analysis of relevant legislative documents concerning the role and competency of the Legislation Council, considerable attention is devoted to real functioning of the Legislation Council and its bodies in practice. Real functioning of the Legislation Council in different time periods is documented in concrete examples. It shows that a formal setting up of the Legislation Council wasn´t always a decisive factor for the influence on the legislative process and it didn´t always primarily regulate its activity. However, the decisive factor has always been the relationship of the government and its ministers to the Legislation Council. This relationship has been significantly influenced by the conduct of the Prime minister. The activity of the Legislation Council has also always been influenced by its chairmen. Periods during which the Legislation Council was not presided by a member of the government as well as the periods stigmatized with frequent exchanges of chairmen of the Legislation Council were the most critical for the Legislation Council´s activity. In spite of the various phases which the Legislation Council has come through, in spite of various influences to which it has been exposed, it has played a positive role in the development of the Czech legislature.
