K charakteru lhůty pro podání žaloby proti rozhodnutí správního orgánu ve věci soukromého práva (§ 247 o. s. ř.)

Shrnutí:

Autor článku se zabývá tím, do kdy lze podat žalobu brojící proti rozhodnutí správního orgánu ve věci soukromého práva. Domnívá se, že dvouměsíční lhůta pro její podání je zachována i tehdy, když žalobce v poslední den této lhůty podá žalobu na poště. V takovém případě nevadí, když návrh dojde soudu až po lhůtě. Zda se k tomuto stanovisku připojí i Nejvyšší soud, ukáže čas. Jeho judikatura je prozatím v tomto směru neujednocená. Naproti tomu Ústavní soud pokládá lhůtu k podání žaloby za lhůtu procesní, a proto uzavírá, že postačí, je-li návrh podán v této lhůtě na poště.

On the time limit to file a complaint against the decision of administrative authority in a private law matter

Summary:

The Author of the article deals with a question, till when it is possible to file a complaint against the decision of administrative authority in a private law matter. The Author considers that the two-month time limit for filing the complaint is met even if the complainant sends the complaint by the post-office on the last day. In such a case it does not mind if the complaint reaches the court after the time limit. We will see in the future if the Supreme Court will share this opinion. Its judicature is not consistent for the time being. On the contrary, the Constitutional Court con-siders the time limit for filing the complaint procedural time limit, in its opinion, it is sufficient to send the complaint by the post-office within this time limit.
