How to Proceed During Checks
What to avoid, and what to abide
- Respect regulations – do not give a reason for being checked; make sure you do not transport prohibited objects, or in any other way violate the rules of neighbouring countries.
- Submit yourself to a check – any resistance to requests to prove your identity or checks of your car / luggage is a legitimate reason for you to be apprehended and taken to a police station.
- Request checking persons to prove their identity – both police and customs officers are obliged to prove their police/customs membership – however such an obligation often relates to the request of a checked person. This applies also to checks carried out by officers dressed in plain clothes.
- Ask about the purpose of the check – there is no lawful reason for checking officers to disclose their reasons. However, you may try. You might be given some information.
- If your personal belongings are being checked either by federal or Bavarian police, request a written certificate confirming such a check.
- If you think that the scope of the check and, in particular, the manner by which it was carried out exceeded reasonable limits, note down the service number of a police/customs officer, place and time of the check – you will need this information if you want to file a complaint regarding the check. It would be also good if you can take a photo or video record on the check according to the relevant national legislation.
